The DC Circuit Court Addresses Silica – a commentary on OSHA silica standards

Dr. Franklin Mirer, professor in the CUNY Graduate School of Public Health and Health Policy (CUNY SPH) department of Environmental, Occupational, and Geospatial Health Sciences, has published a commentary on the DC Court of Appeals decision rejecting industry challenges to the OSHA silica standard, but remanding the standard to OSHA to reconsider adding to the medical surveillance protections. The court upheld OSHA’s analysis showing considerable risks of silica exposure for COPD, lung cancer, and silicosis, even at the new PEL, and deciding the feasibility of achieving those levels.

The commentary was published in the April issue of the Synergist, a publication of the American Industrial Hygiene Association (AIHA).
